This Privacy Policy governs the manner in which The Lifeskills Co SA (a Belgium registered company), Citizen Kids Ltd (a UK registered company), and The Little Gym Franchisees (“The Little Gym® Europe”, “TLGE” or “We” or “we”) collect, process, maintain and disclose your personal data. It also defines your rights as a data subject and how you can exercise them.

This Privacy Policy applies to the app The Little Gym (“the Site” or “this Site” or “our Site”) and all products and services offered by The Little Gym® Europe.

By using this Site, or providing your personal data to TLGE, you signify your acceptance of having your personal data collected, processed and shared in accordance with this Policy. Personal data is any information which personally identifies you or your child.

Generally, we may collect from you the information that is described below, and use it for the purposes described below. You can limit the information that you provide us by not submitting the online request forms described below, in which case you will not be eligible for the product or service requested in the form.

This policy does not apply to, and TLGE is not responsible for, the privacy policies or practices of websites operated by others, even if they are linked to TLGE’s Site. If you choose to link to or from another website to or from the TLGE’s Site, you should refer to that other website’s privacy policy and practices.

Each local The Little Gym® unit is independently owned and operated by a franchisee that will respect this Privacy Policy.

Controller of the data processing

The Lifeskills Company S.A. (“TLC”), located, 3 rue Abbé Cuypers, 1040 Etterbeek (Bru.), Belgium, is the controller of the processing of the personal data collected from you.

We take our data protection responsibilities very seriously and we comply with all applicable data protection legislation in force. For the purposes of this Privacy Policy, “Data Protection Rules” means the EU Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) (“GDPR”) and any laws in the EU giving effect to its provisions.

Scope and sources

This Privacy Policy governs the processing of personal data concerning The Little Gym® Europe members (parents, children, participants…) or people interested in our products and services.

Our sources are:

• Subscription to our products and services;

We collect your data when you decide to subscribe to our products and services or events, create an online account, contact us, visit our Site or otherwise provide information about you to TLGE.

We collect:

• Identification data: your first and last name, child first and last name, child date of birth, legal guardian first and last name and legal guardian’s relation to child;
• Contact data: email address or other electronic contact details, post code, phone number;
• Authentication data: login and password (although we do not have an access to your password);
• Special categories of data: child medical data (when providing it to us for the purposes and in the framework of our products and services and giving us your consent to record and process it);
• Pictures(when giving us your consent to take and use child pictures for the purposes and in the framework of our products and services);
• Communication preferences: subscriptions to newsletters and promotional electronic communications, subscriptions to our franchise business information. We will only then send you these communications if you have opted in to receive them;
• Financial data: bank-related data and credit card information, in the framework of a contract concluded with us;
• Financial information: estimate of your available liquid capital and approximate net worth, in the framework of an application on becoming a TLGE franchisee;
• Career opportunities: curriculum vitae (“CV”) and cover letter in the framework of a job application.

Using collected information

The Little Gym® Europe may collect and use your personal information for the following purposes:

Subscribing to our products and services

The Little Gym® Europe provides the following products and services: book an introductory visit, enrol a child in one of our products or services (class or camp), book a birthday party or participate to one of our local events.

If you wish to book an introductory visit, enrol your child in one of our products or services or book a birthday party, you may do so: (i) in person at your local The Little Gym® unit; or (ii) by selecting a local The Little Gym® unit and using the online form which includes personal information such as your name, first name, first and last names and ages of your child, post code, contact information and, when required, medical data and opt-in to promotional electronic communications, and your consent to process them.

The local The Little Gym® units are independently owned and operated by a franchisee. TLGE and the franchisee may retain your personal data
to further contact you about your subscribed products or services. The data that we process are needed for the performance of the contract that you conclude with us. We base these data processing operations on our contractual relation.

We also use this data internally to perform reporting, statistics and analyses to better manage and enhance the quality of our products and services. We base these data processing operations on our legitimate interest.

We keep this data as long as needed for the provision of the products and services and to perform our financial, accounting obligations and other legal obligations. We keep your data for five (5) years after the end of the products and services or your last interaction with TLGE to perform analyses and prospection actions in accordance with the Data Protection Rules.

We work with service providers located in Europe and the United States of America. We have followed the applicable required Data Protection Rules: we have concluded the EU Standard Contractual Clauses with our American providers. These guarantees provide an adequate protection of your data and enable you to exercise your rights even in the United States of America.

Sending information about our products and services

We may use your personal data to send you information and updates regarding your subscription. It may also be used to respond to your inquiries, questions, and/or other requests.

We base these data processing operations on our legitimate interest or on your explicit, prior consent if you are an existing client and on your explicit, prior consent if you are not already a client.

With your consent we may send you information regarding our products and services or events, as well as promotional electronic communications.These communications can be personalised from time to time such as addressed to groups of customers who have subscribed to the same categories of services and products, celebrating their birthdays in the following month or who have not re-enroled to our products and services in a specific timeframe. You can unsubscribe at any time from receiving such promotional electronic information: unsubscribe instructions are mentioned at the bottom of each digital newsletter and you can also contact TLGE directly for this (please see our contact details below).

We keep your data for five (5) years after the end of the products and services or your last interaction with TLGE. If you have not attended or purchased our products and services or had any contact with TLGE for five (5) years, your data will no longer be identifiable in our databases.

We work with service providers located in Europe and the United States of America. We have followed the applicable required Data Protection Rules: we have concluded the EU Standard Contractual Clauses with our American providers. These guarantees provide an adequate protection of your data and enable you to exercise your rights even in the United States of America.

Recruiting employees

If you’re interested in working at The Little Gym® Europe or within a local The Little Gym® unit, you may send your CV to TLGE or to any franchisee by submitting the “Join the team” form on the “Contact Us” page located on each local website of our Site or the “Sitely now” form on a shared link provided to you.

We base these data processing operations on our legitimate interest to receive applications for vacancies in our company or on your explicit, prior consent.

If you send your CV to TLGE, it may share your CV with franchisees located near you, but it will not rent, sell, or otherwise disclose the personal information from your CV to any other third party.

TLC and its franchisees receiving your CV will process it according to the Data Protection Rules. They will keep it for one (1) year if they do not hire you. If they hire you, they will keep your information during your employment period and for seven (7) years after the end of your employment or according to their legal obligation to keep personnel related data.

Becoming a franchisee

If you are interested in learning about franchise opportunities with TLGE, please refer to www.thelittlegymfranchise.eu. If you wish to share your personal information with TLGE through the online form, the information you will fill out will be collected by TLGE. We may later send you an email that collects additional information, including financial information such as an estimate of your available liquid capital and approximate net worth.

We base these data processing operations on our legitimate interest to further expand our franchise network or on your explicit, prior consent.

We do not hold your data and information if you are not selected as a candidate on becoming a franchisee. We keep your data and information as a selected candidate for two (2) years after your last interaction with TLGE in the case you have not become a TLGE franchisee. We retain your information and data as a selected candidate having signed a franchise agreement with TLGE as long as needed for the provision of the contract and to perform our financial, accounting and other legal obligations.

TLGE will not sell, rent, or otherwise disclose the information you provide without first obtaining your consent. However, if you are an employee of a current TLGE franchisee, we may communicate the fact of your application to your current employer.

How we protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect your personal data against unauthorised access, alteration, disclosure or destruction. We have implemented organisational and technical measures to secure your data. We also have requested the technical service providers (which are hosting, maintaining or managing the data) we are working with to protect your data.

The following security measures are implemented:

• Identity and Access management;
• Intrusion Detection systems;
• Firewalls;
• Anti-virus;
• Logs and access monitoring;
• Encryption of credit cards and passwords;
• Confidentiality obligations;
• Security policies;
• Procedures to deal with any suspected data security breach.

When you submit personal data, such as credit card information, child information or medical information, this information is encrypted and protected by Secure Sockets Layer Protocol (SSL) or Transport Layer Security (TLS) encryption technologies and stored using standard security procedures and practices appropriate to the nature of the information. However, no transmission over the Internet and no electronic data storage method is 100% secure. Therefore, we cannot guarantee the absolute security of the personal information you provide to TLGE either during its transmission or its storage.

If you believe that the security of your data has been compromised, please notify TLGE immediately, and if it involves your credit card, immediately notify your credit card company in accordance with their policies.

Sharing your personal information

We share your personal data within our The Little Gym® Europe network (including with our independent local franchised units) and with several trusted third parties:

• Third parties that provide products and services on our behalf and in accordance with our instructions (such as database management system, marketing agencies that help us prepare or send advertising campaigns…);
• Web analytics tools (via the use of cookies);
• When we are required to do so by law, regulation or legal process (such as a court order);
• In response to requests by government agencies, law enforcement authorities;
• We do not share or sellyour contact details with third-party companies. The third-party companies might propose their products or services through our newsletters when approved by TLGE and these products and services are related to our own products and services;
• When we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.

We reserve the right to transfer any data we have about you in the event we sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to ensure that the transferee uses the data you have provided to us in a manner that is consistent with this Privacy Policy. Following such a sale or transfer, you may contact the transferee with any inquiries concerning the processing of this information.

We may share anonymous aggregated demographic information regarding visitors and users with our business partners, trusted affiliates and advertisers. We may organise common marketing campaigns with these partners without however transferring your personal data to them.

Protecting the privacy of young children is especially important to us. For that reason, our Site is not structured to attract anyone undersixteen (16) years old. Children under the age of sixteen (16) must ask a parent or legal guardian to provide us any personal data online.

Your rights

Right to access your data and to rectify it

You have a right to access your data, to obtain a copy of it and to rectify it. You can exercise these rights by sending a request, with a proof of your identity, to your local The Little Gym® unit or to TLGE atprivacy@thelittlegym.eu. If you send a copy of your identity (“ID”) card or international passport to prove your identity, we recommend that you hide the card number and your picture. In addition to that, please mention on the copy that it may only be used by The Little Gym® Europe or your local The Little Gym® unit.

Right to object to the use of your data for direct marketing purposes

At any time you can withdraw the consent you gave us to receive electronic promotional communication. You can do this by clicking on the “unsubscribe” link at the bottom of any newsletter you will receive (i.e. your local The Little Gym® unit newsletter). You can also ask your local The Little Gym® unit to register your unsubscription.

Right to object to other data processing activities, to restrict processing and to erase data

You have the right to object at any time, on grounds related to your particular situation, to the processing of your data that we perform on the basis of our legitimate interest. Please contact us by explaining the reasons why you object to such processing.

You have the right to obtain (proof of) the erasure of your data (i) when such data is no longer necessary for the purpose for which they were collected, (ii) when you withdraw your consent, or you object lawfully to its processing, (iii) when your data has been unlawfully processed, when your data must be erased for complying with a legal obligation. We will erase your data if we do not have any legal obligation to keep it.

When you have provided your consent to us to process your data, or when it is necessary for the performance of a contract we have concluded with you, you have the right to receive this data in a structured, commonly used and machine-readable format. This right has a very limited application in the context of The Little Gym® Europe products and services. If you send a copy of your ID card or international passport to prove your identity, we recommend that you hide the card number and your picture. The Little Gym® Europe has the discretion to update this Privacy Policy at any time. When we do, we will revise the updated date at the bottom of this page.
